Representative Daryl Metcalfe out of Butler County proposed a resolution to impeach PA Governor Tom Wolf today over his handling of Covid 19 and the continued shut down. This comes following Wolf’s unprofessional outburst at business owners and counties determined to defy continued shut down orders in which Wolf made a public speech calling the people of the State and their elected officials ‘cowards’ and ‘traitors’ in the war against Covid 19, leaving a lot of those officials irate over how listening to the people they represent equates to being a coward and a traitor. Representative Russ Diamond posted a passionate video speech in response in which he methodically explains our Constitution and the provisions that Wolf is violating along with an explanation that the PEOPLE can tear down this government in any way they choose, to uphold our Constitution in the face of tyranny, and that there is no situation in which our Constitution allows for the violation of our rights. He even alludes to the fact that we would have the right to take up arms and tear this government down to restore our rights and the danger that Wolf’s blatant violations impose for the people of our State. In that statement Wolf also threatened all residents and elected officials with reprisals that would actually constitute a severe abuse of his powers if attempted, like withholding federal funds and assistance, and ordering state licensing agencies to revoke licenses of businesses, and even revoking Use & Occupancy permits of businesses that open, in spite of the fact that U&O permits are controlled by the County and Municipal Governments, not the State.
It was this speech and a culmination of watching Wolf tear our state apart and harm the citizens that prompted us, Citizens Against Abusive Power Systems, to take action and e-mail every State Republican office holder to insist that they take action and call for Wolf’s impeachment. Representative Metcalfe listened and proposed that resolution today. CAAPSorg Founder, John Marchetti states,
“We have been working tirelessly 16-20 hours per day for the Citizens of PA, as well as citizens in other parts of the Country like Texas, New Jersey and Michigan, to help fight for their rights and stop the constitutional abuses. We will not stop, even long after things return to normal, and I am not talking about a ‘NEW’ normal – there is no such thing. ‘New’ normal means somebody is getting screwed or being violated; I am talking about our normal. After things have been straightened out, and things return to normal, the people deserve justice and compensation for the violations. I am very grateful to Rep. Metcalfe for calling for a resolution to impeach Wolf and my organization will assist in any way that it can to make it happen.”
There is still work to be done and it is going to require the assistance of the citizens. The citizens need to stand up and contact their representatives and ask them to vote for the resolution. Where possible, they should donate to the causes and the people that are making this happen as everything has a financial cost. CAAPS is a primary sponsor of the Open For Business protest set to begin on May 20, 2020, in which we are asking all business owners that want to open to do so in direct defiance of dictator governor’s shut down orders and illegal violations of their rights. In addition to the effort that has resulted in the request for impeachment of Tom Wolf, we continue to work in the background to contact local law enforcement and DA’s and request that they do not enforce Wolf’s orders, as well as not prosecute businesses that open. All of these things take cooperation from the people themselves, to stand up and fight and continue to fight. We will also continue to expand our network of attorneys that are giving individuals and businesses legal assistance, and also work with governments and police officers that face reprisals for refusing to enforce unconstitutional laws.
One small success, in the proposal of the impeachment resolution is a great achievement but we must continue forward until the job is done and all rights are restored. Rep. Metcalf’s call for impeachment covers many other issues than just the shut down of our businesses. This is what the proposed resolution states:
“Gov. Wolf’s orders in response to the COVID-19 outbreak have violated a number of our God-given rights affirmed in the United States Constitution. In particular, his order mandating the closure of physical locations of all businesses that he has deemed ‘non-life sustaining’ has violated our citizens’ rights in many devastating ways.
His order constitutes a taking of property from business owners without just compensation. The lack of due process and judicial review permitted under his order also violates the Constitution. In addition, this order coupled with the stay-at-home order, has violated our rights to free speech and assembly.
Another troubling aspect of his mandates is the utter lack of transparency demonstrated by the administration during this time, as agencies under his control have stopped responding to requests for records and his office has refused to provide vital information. The waiver process established under the Department of Community and Economic Development resulted in arbitrary and capricious decisions about which businesses may stay open. The public, press and General Assembly all have the right to know about these decisions and how they have been made. While the Wolf administration has finally slowly begun to release some of the relevant information regarding which businesses received waivers, they have yet to release any information about how or why these decisions were made. His delays and obfuscation have been, and continue to be, entirely unacceptable.
His failure to adequately administer our unemployment compensation system has made it so that countless Pennsylvanians who have recently become unemployed due to his orders have been unable to collect the benefits they require to meet their basic needs.
“His focus on restraining business is particularly disturbing, as the majority of deaths due to the pandemic have been residents of long-term care facilities. The governor should have focused his attention there, but he has entirely failed to implement a comprehensive state plan to protect our most vulnerable citizens who reside in nursing homes, which have had inadequate supplies of Personal Protective Equipment and testing kits throughout the outbreak.
As Gov. Wolf has violated so many of our fundamental rights as citizens of the Commonwealth, I will be introducing a resolution impeaching the governor and exhibiting Articles of Impeachment to the Senate. His actions plainly constitute the misbehavior in office required for his impeachment under the Pennsylvania Constitution.
While these are certainly challenging times, Gov. Wolf must be held accountable for his actions that have harmed so many of our citizens and violated so many of our rights. No individual or office is above the law.”
